The trial of a veteran republican accused of trying to murder a UDR soldier 30 years ago has been adjourned pending the hearing of a legal application to have the case against him thrown out.
Lawyers for Terence Gerard McGeough, 51, are seeking to have the case dismissed through an abuse of process order and their application will be heard next week.
At Belfast Crown Court on Friday Mr Justice Stephens said he wanted to be kept informed about the progress of the application and scheduled an update for a week's time.
The court has heard that McGeough was shot in the chest by the intended victim Samuel John Brush, as the part-time soldier and full time postman fought back when he was attacked near Aughnacloy in County Tyrone by two men on 13 June 1981.
McGeough from Carrycastle Road, Gortmerron, Dungannon is denying the attempted murder of Mr Brush and possessing two Colt revolvers used in the attack.
He is also denying two counts of IRA membership between January 1975 and June 1981.
Alongside him in the dock is Vincent McAnespie, 47, from Aghabo Close in Aughnacloy who denies possessing the guns and ammunition with intent to endanger life and under suspicious circumstances.
He also denies a further charge of impeding the apprehension of McGeough by hiding the guns.
