The Belfast Crown Court jury had deliberated for more than six hours over two days before telling trial Judge Geoffrey Miller QC that they were hopelessly split.
They had heard allegations that former soldier 32-year-old Francis Eliason raped a woman in the toilet of the Kremlin bar in the city centre in September 2010.
While his alleged victim claimed she was raped Eliason - formally from Palace Barracks in Holywood - counterclaimed the sex was consensual.
Thanking the jury for their service, Judge Miller listed the case for mention next week.
