The 26-year-old Bangladeshi man was detained at the Cinnamon Club on Downs Road in the Co Down town last Thursday.
Authorities from the UK Border Agency paid an unannounced visit and carried out checks which showed the suspect had overstayed his visa.
The restaurant faces a potential fine of up to £10,000 if it fails to prove proper pre-employment checks were carried out.
Mike Golden of the UK Border, said: "Foreign nationals who are in this country illegally should be in no doubt that they will be found, arrested and removed from the UK.
"Companies that think they can undercut competitors by employing illegal workers should be warned that they will face heavy fines and possible prosecution."
The man is now being held in immigration detention in Larne House, Larne while steps are taken to remove him from the UK.
