There was no formal agreement between all the parties, however, the proposals were confirmed in a statement by the First and Deputy First Minister late on Tuesday night.
Peter Robinson and Martin McGuinness have asked for responses to the proposals to be submitted by Monday, 16 January.
The work carried out by Minister Stephen Farry's department will be split between the Department of Education and the Department of Enterprise, Trade and Investment.
According to the proposals, the Department of Justice will be still be allocated by cross community support rather than the d'Hondt process used for allocating the other departments.
Alliance Party leader David Ford is expected to continue in the role after May 2012.
Those are the main proposals to come out of the talks that were held on Tuesday night at Stormont Castle.
The legislative process to wind up the work of the Department of Employment and Learning is expected to take between three and four months.
The d'Hondt process will be re run once the Department of Employment and Learning disappears.
