The former wife of New York Governor Andrew Cuomo was arrested in Westchester County on Friday morning after crashing into a tractor trailer.
Police found her sitting at the wheel of her 2008 Lexus after receiving calls suggesting she had been driving erratically before the accident.
She was booked after a sobriety test, but her spokesman, Ken Sunshine, insists the charges against her were made prematurely.
He tells the New York Times: "Kerry Kennedy voluntarily took breathalyzer, blood and urine tests - all of which showed no drugs or alcohol whatsoever in her system. The charges were filed before the test results were available."
The accident comes the same week as news that the body of her beloved sister-in-law, Mary Kennedy, had been moved from its final resting place to another area of the Kennedy family cemetery in Bedford, New York. Mary Kennedy committed suicide this spring.
The late socialite was one of Kerry Kennedy's closest friends.
